Terms of Service
1. General - Scope
1.1 The following terms and conditions apply to all business relationships between the customer and Masternodes Germany, hereinafter referred to as "us". In each case, the valid version at the time of the conclusion of the contract is decisive.
1.2 Deviating, conflicting or supplementary terms and conditions of the customer, even if known, are not part of the contract, unless their validity is expressly agreed.
1.3 Masternodes Germany reserves the right to change these terms and conditions at any time. Decisive for new contracts is the version valid at the time of the conclusion of the contract. Compared to existing customers, the amended terms and conditions apply only under the special requirements.
1.4 With respect to existing customers, a change in the agreed terms and conditions is possible under the following restrictions: circumstances that justify such a change are subsequent, unforeseeable changes that Masternodes Germany does not initiate and over which it has no influence and which are unilaterally at the expense of one party, as well as in the AGB created gaps, which lead to difficulties in the execution of the contract. Masternodes Germany will send the amended terms to the customer four weeks prior to their entry into force, identifying the circumstances surrounding the change and the scope of the changes. If the customer does not object to the change by e-mail before entering into force, but declares his consent to the new terms and conditions by further use of the services of Masternodes Germany, the change is considered accepted. The GTC in its then amended then apply from the date announced for existing contracts. In the case of a timely and effective opposition, the former GTC continue to apply in the relationship between the parties. In this case, both the customer and Masternodes Germany are entitled to terminate the contract with a reasonable period of one month to the end of the month.
2. Conclusion of contract
2.1 Our offers are non-committal and non-binding. Technical and other changes remain within the reasonable limits.
2.2 With the order, the customer declares his contract offer. The contract offer is binding after the master's fashion of the customer has been successfully started.
2.3 We are entitled to accept the contract offer in the order within a period of 2 working days after receipt. However, we are also entitled to reject the acceptance of the order, for example after checking the creditworthiness of the customer.
3. Scope of Services
3.1 Incidentally, the scope of services is based on the offer information valid at the time of the order, the order form and any applicable monthly special offers.
3.2 Technical support services are included in all offers. If requested and claimed, these will not be charged separately.
3.3 Access to the Telegram Support Group is also included in the offer price and is guaranteed for the entire duration of the contract without additional costs.
3.4 Masternodes Germany relies on infrastructures operated by third parties for which Masternodes Germany has no influence. It may therefore come to disruptions or impairments that have their cause outside the sphere of influence of Masternodes Germany, in particular disturbances of the Internet or by force majeure.
3.5 Unless otherwise agreed, Masternodes Germany guarantees the availability of its services and services offered via the Internet. Their availability is given when the servers and services are essentially operational. Disturbances of the operation are not the following circumstances:
1. Interruptions of accessibility due to disturbances in the area of third parties, on which Masternodes Germany has no influence.
2. Interruptions due to force majeure.
3. Short-term interruptions of the business, which are necessary to prevent or prevent concrete threats due to possible misuse by third parties (so-called exploits) (for example through updates)
4.1 Our data protection practice is consistent with the General Data Protection Regulation (DSGVO) and the Federal Data Protection Act (BDSG) as well as the Telemedia Act (TMG).
4.2 Personal data of the customer are only collected and used, as far as they are necessary for the establishment, content or modification of the contractual relationship.
4.3 We use the customer's e-mail address only for informational letters on the orders, for invoices and, if the customer does not object, for customer care.
4.4 We do not pass personal customer data to third parties.
4.5 The customer has a right to information as well as a right to correction, blocking and deletion of his stored data. If deletion violates statutory or contractual retention requirements or other legal reasons, the data will be blocked.
5.1 We accept no liability for direct damages, consequential damages or loss of profit due to technical problems and disruptions within the internet which are not within our sphere of influence.
5.2 If the service can not be completely fulfilled for the present contract offer because of technical reasons on the part of Masternodes Germany, Masternodes Germany is liable for the downtime that is present. The amount for the downtime will be refunded to the customer in this case.
6. Terms of Payment
6.1 The current prices are valid at any time https://masternodes-germany.de are visible.
6.2 Depending on the contractual agreement, a monthly, semi-annual or annual settlement takes place. The invoice will be sent to you by e-mail as soon as your masternode has been successfully started. Monthly billing is done in advance on the last day of the previous month. All fees are then due within 48 hours after receipt of the invoice.
6.3 If payment deadlines are exceeded, we are entitled without further notice to terminate your master trading on our servers with immediate effect.
6.4 Any amounts overpaid will of course be refunded promptly, with any transaction fees deducted from the excess.
6.5 Invoices are sent by e-mail as an attachment.
7. Contract period
7.1 The contract expires at the end of each month, half year or annual package. 2 days before the end of the respective package, the customer receives a consecutive invoice for the further term of the contract. If this invoice is not paid within 48 hours, the contract and thus the term of the Master's Code will be terminated with immediate effect on our servers.
7.2 Place of performance for all services from this contract is Gladbeck. Jurisdiction for all disputes arising from this contract is for Gladbeck local competent court, if the customer is a merchant, legal entity under public law, or public law special fund. The same applies if the customer does not have a general place of jurisdiction in Germany or if his domicile or habitual residence is unknown at the time the complaint is filed. We are also entitled to sue at the customer's location.

9.2 By using the service, you agree to the terms and conditions. If you disagree with any part of the Terms, we expressly advise you not to use this service.
